Employer sponsored visa

  • For Employer: Employer Sponsored Visa is designed to help your business keeping existing talents or attract future talents.
  • For employee: If you are going through interviews and are always stopped when asked about your visa by the employer, then you need to know how to be sponsored.
  • TSS: is Designed to help employers fill positions that are vacant due to labour shortages, allow you to sponsor a worker permanently or temporarily.

The Process:

  • The employer applies to become a registered sponsor.
  • The employee has an occupation on the MLTSSL or ROL applicants are required to provide evidence of their relevant work experience, academic qualifications, English proficiency, in addition to health and good character.

Note: Individual occupations may have caveats, or special requirements  therefore it’s only prudent to consult with a professional in the area giving you and your employer the confidence to sponsor you.

Employers are generally expected to demonstrate that the business is lawfully operating, no suitable Australian employees are available and meet minimum salary and employment conditions.

The 4 Skilled Sponsored Visas are:

  1. Temporary Skill Shortage Visa (TSS) (subclass 482) – A temporary visa with a path to Permanent Residence after 3 years of sponsored employment. Visa length and Permanent Residence options are determined by the nominated occupation.
  2. Employer Nomination Scheme (subclass 186) – The following permanent visa after the TSS visa for certain TSS holders. Applicants who are not TSS visa holders may also be eligible to apply directly, depending on their age, occupation, work experience and holding a skills assessment.
  3. Regional Sponsored Migration Scheme (subclass 187) –  A Regional Permanent visa available to some TSS visa holders who have been employed in their nominated position for at least 3 years. Applicants must be TSS visa holders in a regional area and under a certain skilled occupation list.
  4. Skilled Employer Sponsored Regional (Provisional) visa (subclass 494) – temporary 5-year visa for positions located in Regional Australia. This visa is available for a wider range of occupations and offers a path to Permanent Residence after 3 years of sponsored employment.

ESA are processed in accordance with current Ministerial Directions and those that are on the Priority Migration Skilled Occupation List (PMSOL) currently in Australia will have preference.

As stated on the Department’s website, published global visa processing timeframes.

Applications accorded priority under Ministerial Directions 92 and 93 can expect faster processing times, however as noted above, this is currently being reviewed.

If you lodged your application more than 12 months ago, you can assist our firm by providing the following:

  • A recent statement on business letterhead, signed by the authorised representative of the business confirming that there is an ongoing genuine need for the nominee to fill the position, and that position will be available for at least two years at the nominated salary.
  • For nomination applications, documentation showing income from the current financial year to date, such as company financial statements, lodged Business Activity Statements (BAS) and/or business tax returns. Where not available for most recent months, other independent evidence such as bank statements or bank transaction listings with income identified.
  • Visa applications with valid health and police clearances are likely to be processed more quickly than applications with pending or expired clearances.

TSS or SESR you are eligible to complete health checks before lodgement:

ENS or RSMS visa you are not eligible to complete health checks before lodgement.

Please let us know in your email which Bupa clinic you are likely to attend, and confirm for us that you don’t have any of the following identity documents:

• Current valid passport

• Passport which has expired within two (2) years of the health examination date

• Current valid emergency travel document

• Current valid temporary travel document

Unless the circumstances for your extension request are beyond your direct control AND you have provided supporting evidence from the relevant third party (e.g. information to show that you have taken steps to obtain penal certificates, health checks, AHPRA registration, Health Workforce Certificate, Regional Certifying Body advice, custody documents), your extension request will NOT be approved.
